Terms and conditions of the online shop
§ 1
Introductory provisions
- The Astrodream on-line shop, available at the Internet address www.astrodream.pl, is run by Marcin Rosadziński, who conducts business activity under the name Marcin Rosadziński, registered in the Central Register and Information on Business Activity (CEIDG) maintained by the minister responsible for economy, NIP 8171898785, REGON 529298228.
§ 2
Definitions
1. Seller - natural person running a business under the name of Marcin Rosadziński Astrodream, registered in the Central Register of Business Activity and Information (CEIDG) maintained by the competent minister of economy, NIP 8171898785, REGON 529298228.
2. Customer – a natural person with full legal capacity, and in cases provided for by generally applicable laws also a natural person with limited capacity to perform legal acts; a legal person; or an organizational unit without legal personality, which is granted legal capacity by law; - who has concluded or intends to conclude a Sales Agreement with the Seller.
3. Shop – an online shop operated by the Seller at the website address www.astrodream.pl.
4. Distance contract – contract concluded between the Seller and the Customer within an organized system of contract conclusion at a distance (within the Shop), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to and including the conclusion of the contract.
5. Sales Agreement – an agreement for the sale of a Product concluded or entered into between the Customer and the Seller via the Online Store. The Sales Agreement is also understood - according to the characteristics of the Product - the contract for the provision of services and the contract for specific work.
6. Terms and Conditions – these rules and regulations of the Store.
7. Order – Customer's declaration of intent placed via the Order Form and aimed directly at concluding a Sales Agreement for a Product or Products with the Seller.
8. Account – Customer's account in the Store, where the data provided by the Customer and information about Orders placed by him/her in the Store are stored.
9. Registration form – a form available in the Store which allows for the creation of an Account.
10. Order form – an interactive form available in the Store which enables the placing of an Order, particularly by adding Products to the Basket and defining the terms of the Sales Agreement, including the manner of delivery and payment.
11. Basket – an element of the Shop's software in which the Products selected by the Customer for purchase are visible, as well as the possibility of determining and modifying the details of the Order, in particular the quantity of the products.
12. Product – a movable item/service available in the Store which is the subject of a Sales Agreement between the Customer and the Seller.
13. Business day – one day from Monday to Friday, excluding public holidays.
14. Civil Code– the Civil Code Act of 23 April 1964 (Journal of Laws 1964 No. 16, item 93 as amended).
The customer purchasing products in the online shop www.astrodream.pl is obliged to familiarise himself with the content of these Terms and Conditions. www.astrodream.pl jest obowiązany do zapoznania się z treścią niniejszego Regulaminu.

§ 4
Technical requirements
In order to use the Shop, including browsing the Shop's product range and placing orders for Products, it is necessary to have:
- terminal device with access to the Internet and a correctly configured web browser such as Microsoft Edge, Chrome, Internet Explorer, Opera.
- active electronic mail (e-mail) account,
- cookies enabled,

General information
- To the fullest extent permitted by law, the Seller shall not be liable for any disruption, including interruption to the operation of the Shop caused by force majeure, unauthorized action of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.
- Browsing the range of products in the Store does not require creating an Account. Placing orders by the Customer for Products in the Shop's assortment is possible either after creating an Account (free of charge) in accordance with the provisions of § 6 of the Terms and Conditions or by providing the necessary personal and address data to enable the processing of the Order without creating an Account.
- The price of the Product displayed on the website of the Online Store is given at the choice of the Customer in Polish zloty (PLN), euro (EUR), British pounds (GBP) and United States dollars (USD) and includes taxes. The Customer is informed about the total price including taxes of the Product being the subject of the Order, as well as the costs of delivery (including transport, delivery and postal services) and other costs, and when the amount of these charges cannot be determined - about the obligation to pay them, on the pages of the Online Shop during the placement of the Order, including at the moment of expressing the Customer's will to be bound by the Sales Agreement.
- The final (final) amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including transport, delivery and postal fees), of which the Customer is informed on the pages of the Online Shop during the placement of the Order, including at the moment of expressing the will to be bound by the Sales Agreement.
- The conclusion of a Sales Contract between the Customer and the Seller takes place after the Customer places an Order at the Online Store in accordance with point. §2.10 of the Terms and Conditions.
- If the Customer purchases a "Poster" product, the frames for the "Poster" product are not sold as a set.
- The Customer may select an unlimited number of products for the Order from the products available on the shop's website. When he goes to the Basket, he will receive a summary of the selected Products. If the number of Products is limited, the Store will indicate such information on the product page.
- The Shop informs that all products presented on the shop website www.astrodream.pl, www.astrodream.plare presented with the consent and knowledge of the copyright owner.
- It is forbidden to distribute and copy materials, i.e. photographs, graphics and texts found on the Store's website without the written consent of the copyright owner.
- The colours of the products presented on the Shop's website depend on the quality and accuracy of the parameters of the device used by the customer.
§ 6
Creating an Account in the Shop
- To set up an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data: First Name, e-mail address, telephone number, address of residence.
- Creating an Account in the Store is free of charge.
- Logging into the Account takes place by entering the login and password established in the Registration Form.
- The Customer may at any time, without giving any reason and without incurring any fees for this, delete the Account by sending an appropriate request to the Seller, in particular by e-mail or in writing to the addresses specified in § 3.
§ 7
Rules for placing an Order
To place an Order, you must:
- log into the Shop (optional);
- select the Product that is the subject of the Order and then click on the "Add to basket" button (or equivalent);
- log in or use the option of placing an Order without registration;
- if the option of submitting the Order without registration has been selected - fill in the Order Form by entering the data of the recipient of the Order and the address to which the Product is to be delivered, select the type of shipment (method of delivery of the Product), enter the data for the invoice, if different from the data of the recipient of the Order,
- click the "Order and pay"/click the "Order and pay" button
- choose one of the available payment methods and, depending on the payment method, pay for the Order within the specified time limit, subject to § 8 point 3.
- in the event that the product covered by the order is unavailable from the suppliers of the astrodream online shop, or for other reasons when the order cannot be fulfilled, the shop shall notify the customer of this fact within 14 days, counting from the date of placing the Order. In such a case, the customer has the right to decide whether he/she agrees to fulfil the order within the period proposed by the shop or whether he/she withdraws from the sales contract.
- If the customer decides to withdraw from the contract as described in paragraph §7 point 7, the Store will return the amount paid by the customer.
§ 8
Delivery and payment methods offered
The customer may use the following delivery methods:
- Courier delivery
- Parcel delivery (only available for some products in the shop, due to the size of the products)
Product delivery time - is defined in Business Days. This is the time taken by the Carrier to deliver the Product to the Customer. The Customer is informed about the Product delivery time in the Product card as well as in the "Shipping" tab.
- Delivery within Poland takes 2-5 business days
- Outside Poland in the European Union from 2 to 14 business days.
- Outside the European Union to countries such as USA or Canada up to 20 working days.
Dispatch preparation time: Each print is printed individually to your order and takes up to 3 working days. However, in most cases, the print is prepared within one day of receipt of your order or on the day your order is received.
Delivery time does not include shipping preparation time.
All products sold by the astrodream webshop are packaged appropriately so that they are protected in transit. However, should the customer notice damage to the packaging upon receipt of the product, they are requested to document the damage accordingly and report it to the carrier in order to secure a potential claim.
- The customer may use the following payment methods:
- Payment by bank transfer to the Seller's account
- Possible current methods of payment are specified on the website of the Online Shop in the information tab concerning payment methods and on the website http://www.przelewy24.pl/.

- Przelewy24.pl - the company PayPro S.A. Settlement Agent with registered office in Poznań (registered office address: ul. Kanclerska 15, 60-327 Poznań), entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań - Nowe Miasto and Wilda in Poznań, VIII Economic Department of the National Court Register under KRS number 0000347935, NIP 7792369887, Regon 301345068.
- Payment term:
- If the Customer chooses to pay by bank transfer, electronic payment or payment card, the Customer is obliged to make payment within 7 calendar days of the conclusion of the Sales Agreement - otherwise the order will be cancelled.

§ 9
Execution of the sales contract
- The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer places an Order through the Order Form in the Online Shop in accordance with § 7 of the Terms and Conditions.
- After placing an Order, the Seller shall immediately confirm its receipt and at the same time accept the Order for fulfilment. Confirmation of receipt of the Order and its acceptance for processing shall be made by the Seller sending to the Customer a relevant e-mail message to the Customer's e-mail address provided during the Order placement process, which contains at least the Seller's statements of receipt of the Order and its acceptance for processing as well as confirmation of concluding the Sales Agreement. As soon as the Customer receives the above email, the Sales Agreement between the Customer and the Seller is concluded.
- If the Customer chooses:
- payment by bank transfer, electronic payment or payment card, the Customer is obliged to make the payment within 7 calendar days from the date of concluding the Sales Agreement - otherwise the order will be cancelled.
- If the Customer has chosen the method of delivery, the Product shall be dispatched by the Seller within the period indicated in its description (subject to paragraph 5 of this section), in the manner selected by the Customer when placing the Order.
- A In the event of ordering Products with different delivery dates, the delivery date is the longest date given.
B When ordering Products with different delivery times, the Customer has
the option to request the delivery of the Products in parts
or the delivery of all the Products once the entire order has been completed.
- The beginning of the delivery period of the Product to the Customer is counted as follows: a. In the event that the Customer chooses to pay by bank transfer, electronic payment or payment card - from the date of crediting the Seller's bank account.
- In the event that the Customer chooses to pay by bank transfer, electronic payment or payment card - from the date of crediting the Seller's bank Account.
In the event of ordering Products with different dates of readiness for collection, the date of readiness for collection is the longest given date.
The Product is delivered in Poland, the European Union countries, the United Kingdom, the United States and Canada.
Delivery of the Product to the Customer is chargeable, unless the Sales Agreement provides otherwise. Product delivery costs (including transportation fees) are indicated to the Customer on the pages of the Online Shop under "Delivery Costs" and during Order placement, including at the moment of expressing the Customer's will to be bound by the Sales Agreement.
§ 10
Right of withdrawal
- The Consumer may within 14 days withdraw from the Sales Agreement without giving any reason.
- The period referred to in paragraph (1) shall begin from the delivery of the Product to the Consumer or a person designated by the Consumer other than the carrier.
- In the case of an Agreement that includes multiple Products that are delivered separately, in batches or in parts, the period indicated in paragraph 1 shall run from the delivery of the last item, batch or part.
- The Consumer may withdraw from the Contract by submitting a statement of withdrawal from the Contract to the Seller. Sending the statement by the Consumer before the expiry of this deadline shall be sufficient to meet the deadline for withdrawal from the Contract.
- The statement may be sent by traditional mail to the address of the shop, i.e.: ul. Wąwozowa 59, 32-085 Modlniczka or electronically by sending a statement to the e-mail address of the Seller ( kontakt@astrodream.pl ) Model statement constitutes attachment No. 1 to these Regulations.
- Effects of withdrawal from the Contract:
- In the case of withdrawal from a Contract concluded remotely, the Contract shall be deemed not to have been concluded.
- In the case of withdrawal from the Agreement, the Seller shall reimburse to the Consumer immediately, no later than within 14 days from the date of receipt of the Consumer's declaration of withdrawal from the Agreement, all payments made by the Consumer, including the costs of delivery of the goods, except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest ordinary method of delivery offered by the Seller.
- The Seller shall refund the payment using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer has expressly agreed to another solution that will not incur any costs for the Consumer.
- The Seller may withhold reimbursement until it has received the Product back or until it has been provided with proof of return, whichever event occurs first.
- The Consumer is obliged to send back the Product to the Seller's address given in these Terms and Conditions immediately, no later than 14 days from the day on which he informed the Seller about the withdrawal from the Contract. The deadline shall be met if the Consumer sends back the Product before the expiry of the 14-day period.
- The Consumer shall bear the direct costs of returning the Product.
- The Consumer shall be liable for any reduction in the value of the Product resulting from the use of the Product other than what was necessary to establish the nature, characteristics and functioning of the Product.
The right of withdrawal from a contract concluded at a distance shall not be granted to the Consumer
in relation to a Contract:
- in which the object of the performance is a non-refabricated item, produced to the Consumer's specifications or serving to satisfy his individualised needs,
- in which the object of the performance is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons, if the packaging has been opened after delivery,
- for goods which are perishable or have a short shelf life,
- for the provision of services, if the Seller has performed the service in full with the express consent of the Consumer, who has been informed before the performance of the service by the Seller that after the Seller's performance he will lose the right to withdraw from the Agreement,
- in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the expiry of the deadline for withdrawal from the Agreement,
- in which the subject of the performance are things which, after delivery, by their nature, become inseparably connected with other things,
- in which the subject of performance is alcoholic beverages, the price of which has been agreed upon at the conclusion of the sales contract, the delivery of which may only take place after 30 days and the value of which depends on fluctuations in the market over which the Seller has no control,
- where the subject matter of the performance is a sound or visual recording or computer software supplied in sealed packaging if the packaging has been opened after delivery,
- for the supply of newspapers, periodicals or magazines, except for a subscription contract,
- for the supply of digital content which is not recorded on a tangible medium if the performance has begun with the express consent of the Consumer before the expiry of the withdrawal period and after the Seller has informed the Consumer of the loss of the right to withdraw from the Agreement,
§ 11
Complaint and warranty
- The basis and scope of the Seller's liability towards the Customer if the sold Product has a physical or legal defect (warranty) are defined by the generally applicable provisions of law, in particular the Civil Code (in particular Articles 556-576 of the Civil Code). For Sales Agreements concluded until 24 December 2014, the basis and scope of the Seller's liability towards the Customer who is a natural person and who acquires the Product for the purpose not related to professional or business activity, for non-compliance of the Product with the Sales Agreement are defined by generally applicable laws, in particular the Act of 27 July 2002 on special conditions of consumer sales and amending the Civil Code (Journal of Laws 2002 no. 141, item 1176 as amended).
- The Seller is obliged to provide the Customer with the Product without defects.
- A complaint may be lodged by the Customer:

- in electronic form via e-mail to the following address: marcin.rosadzinski@astrodream.pl.
- It is necessary for the Customer to provide in the description of the complaint: (1) information and circumstances concerning the subject of the complaint, in particular the type and date of occurrence of the defect; (2) request for the method of bringing the Product into conformity with the Sales Agreement or declaration of price reduction or withdrawal from the Sales Agreement; and (3) contact details of the complainant - this will facilitate and accelerate the processing of the complaint by the Seller. The requirements specified in the preceding sentence shall be in the form of a recommendation only and shall not affect the effectiveness of complaints submitted with the omission of the recommended description of the complaint.
- The Seller shall respond to the Customer's complaint immediately, no later than within 14 calendar days of its submission. If the Customer, who is a consumer, has demanded replacement of the item or removal of the defect or has made a declaration of price reduction, specifying the amount by which the price is to be reduced, and the Seller has not responded to this demand within 14 calendar days, it shall be deemed that the demand was justified.
- The Customer who exercises the rights under warranty shall be obliged to deliver the defective Product to the address: ul. Wąwozowa 59, 32-085 Modlniczka. In the case of a Customer who is a consumer, the cost of delivery of the Product shall be borne by the Seller, in the case of a Customer who is not a consumer, the cost of delivery shall be borne by the Customer.
§ 12
Out-of-court complaint and redress procedures
- 1. Detailed information about the possibility to use out-of-court procedures for handling complaints and pursuing claims by the Consumer and the rules of access to these procedures are available at the offices and websites of district (city) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Provincial Inspectorates of Commercial Inspection and at the following Internet addresses of the Office of Competition and Consumer Protection: http://www.uokik.gov.pl/spory_konsumenckie.php; http://www.uokik.gov.pl/sprawy_indywidualne.php and http://www.uokik.gov.pl/wazne_adresy.php.
- The consumer has the following exemplary possibilities of using out-of-court ways of dealing with complaints and claims:
- The Consumer shall be entitled to apply to the permanent amicable consumer court referred to in Article 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended) to resolve a dispute arising from the Agreement concluded with the Seller.
- The Consumer shall be entitled to apply to the provincial inspector of the Commercial Inspection, pursuant to Article 36 of the Act of 15 December 2000 on Commercial Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings for the amicable settlement of a dispute between the Consumer and the Seller.
- The Consumer may obtain free assistance in resolving a dispute between him and the Seller, using also the free assistance of a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (e.g. Federation of Consumers, Association of Polish Consumers).
§ 13
Personal data in the Online Shop
- The administrator of Customers' personal data collected via the Online Store is the Seller.
- Customers' personal data collected by the administrator via the Online Store are collected for the purpose of fulfilling the Sales Agreement, and if the Customer agrees - also for marketing purposes.
- Recipients of personal data of the Customers of the Online Store may be:
- In the case of a Customer who uses postal or courier delivery in the Online Store, the Administrator shall make the collected personal data of the Customer available to the selected carrier or intermediary performing the delivery on behalf of the Administrator.
- If the Customer uses electronic or card payment method in the Online Shop, the Administrator shall make available the collected personal data of the Customer to a selected entity handling the above-mentioned payments in the Online Shop.
4. The Customer has the right to access his/her data and correct them.
Provision of personal data is voluntary, although the failure to provide the personal data specified in the Terms and Conditions necessary to conclude the Sales Agreement results in the inability to conclude this agreement.
§ 14
Final provisions
1. Contracts concluded through the Online Shop shall be concluded in the Polish language.
2 The applicable law is Polish law. Disputes arising between the Customer and the Seller shall be settled by the court having jurisdiction over the Seller's registered office, with the proviso that in relation to Consumers, such disputes shall be settled by the court having jurisdiction under the provisions of civil procedure.
The Seller reserves the right to make changes to these Terms and Conditions for important reasons, i.e.: changes in the law, changes in methods of payment and delivery - to the extent to which these changes affect the implementation of the provisions of these Terms and Conditions. The Seller will inform the Customer about each change at least 7 days in advance.
Matters not regulated in these Terms and Conditions shall be governed by generally applicable provisions of Polish law, in particular: Civil Code; Act on Provision of Electronic Services; Act on Consumer Rights, Act on Personal Data Protection.
